Please read these Terms of Service ("Terms") carefully before using Shouty ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Shouty, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
2. Description of Service
Shouty is a macOS application that converts speech to text using your device's microphone and Apple's Speech Recognition technology. The transcribed text is automatically copied to your clipboard for easy pasting into other applications.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices that you own or control.
4. Restrictions
You agree not to:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices from the App
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any systems or networks connected to the App
5. Intellectual Property
The App and its original content, features, and functionality are owned by Shouty and are protected by international copyright, trademark, and other intellectual property laws.
6. User Content
You retain all rights to the content you create using the App (your transcriptions). We do not claim any ownership over your transcribed text or recordings.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of transcriptions
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Speech recognition accuracy may vary based on audio quality, accent, background noise, and other factors.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SHOUTY, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits or revenue
- Loss of data
- Loss of use
- Any damages arising from transcription errors
9. Indemnification
You agree to indemnify and hold harmless Shouty and its developers from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
10. Third-Party Services
The App uses Apple's Speech Recognition framework. Your use of this feature is also subject to Apple's terms and conditions. We are not responsible for the performance, accuracy, or availability of Apple's services.
11. Modifications to the App
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
12. Changes to Terms
We may revise these Terms at any time. By continuing to use the App after changes become effective, you agree to be bound by the revised Terms. We encourage you to review these Terms periodically.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
